The Penal Code establishes serious consequences for its authors. Thus, and as far as the basic scam is concerned, a prison sentence of 6 months to 3 years is foreseen when the amount exceeds 400 euros. Otherwise, we will face a minor offense (now that the offenses have disappeared from the Code) sanctioned with a fine of 1 to 3 months.
When specifying the penalty within the generic framework that we have indicated, the judge must attend to the amount cheated, to the loss caused to the victim, to what were the relations between them and the author of the crime and to the rest of the elements that have concurred in their commission.
